Terms of Service & AUP

1. Acceptance of Terms & Service Scope

By accessing, browsing, registering for, or using VidExtend (referred to as the "Service", "Platform", or "We"), you agree to be legally bound by these Terms of Service, all applicable laws and regulations, and our Acceptable Use Policy (AUP).

Our Service provides generative AI tools including Animate Photo, Photo Animation, Image to Video, Video Generation, and motion synthesis tools. If you do not agree with any part of these terms, you must immediately cease accessing and using our Platform. These Terms apply to all visitors, registered creators, subscribers, and API consumers.

2. User Accounts, Authentication & Security

To access AI video generation workbench tools and maintain credit balances, you must register for an account via Google OAuth or verified email magic link.

You are solely responsible for safeguarding your login credentials and maintaining the confidentiality of your account. You agree to notify us immediately of any unauthorized access, account compromise, or security breach.

3. Credits, Subscriptions & Payment Terms

Our service operates on a compute credit-based consumption model for AI video generation and photo animation:

• Monthly & Yearly Subscriptions: Subscribers receive a recurring monthly or annual quota of generation credits. Recurring subscription plans renew automatically at the end of each billing cycle unless cancelled prior to the renewal date.
• Pay-As-You-Go Packs: One-time credit packs do not renew automatically, and purchased credits remain valid as long as your account remains in good standing.
• Merchant of Record: All order processing, checkout, currency conversions, applicable sales taxes, and subscriptions are managed securely by our authorized Merchant of Record, Creem.
• Refund Policy: Due to the immediate allocation of high-performance GPU compute clusters for AI inference, credit deductions are non-refundable once video processing commences, except as required by mandatory consumer protection laws or explicit Creem billing policies.

4. Intellectual Property & Commercial Usage Rights

We believe creators should own their creative outputs:

• Your Inputs: You retain full ownership and intellectual property rights in all still photos, images, and creative text prompts you submit to the Platform.
• Your Generated Outputs: Subject to your compliance with these Terms and applicable laws, you own all rights, title, and interest in the dynamic videos generated by the AI based on your inputs.
• Commercial Use License: Active paid subscribers (Pro, Ultra) and Credit Pack purchasers receive full commercial rights to use generated video assets for marketing, social media, client projects, advertising, and broadcast.
• Platform Rights: The VidExtend name, logo, UI/UX designs, algorithms, and documentation are the exclusive intellectual property of the Service provider.

5. AIGC Content Standards & Acceptable Use Policy (内容标准与禁止类别)

You agree to use our AI photo-to-video generation tools responsibly, ethically, and lawfully. In addition to these Terms, our comprehensive standalone Acceptable Use Policy (/aup/) governs all generative features. You are strictly prohibited from generating, animating, uploading, inputting, prompting, sharing, or disseminating any content within the following six prohibited categories:

• 1. Pornography & Sexually Explicit Content (色情/NSFW内容): Any sexually explicit imagery, pornography, adult content, nudity, sexual acts, non-consensual sexual depictions, or sexually suggestive media.
• 2. Violence, Graphic Gore & Self-Harm (暴力/血腥内容): Any graphic depictions of violence, bloodshed, gore, bodily mutilation, torture, physical injury, self-harm, suicide encouragement, terrorism, dangerous weapon manufacturing, or promotion of physical cruelty.
• 3. Hate Speech, Harassment & Defamation (仇恨言论与骚扰): Content that promotes violence, incites hatred, discriminates, bullies, defames, stalks, or threatens individuals or groups based on race, ethnicity, nationality, religion, disability, gender, age, sexual orientation, or other protected characteristics.
• 4. Child Sexual Abuse Material & Child Endangerment (儿童不安全内容 - CSAM/CSAE): Any material depicting, simulating, generating, promoting, or facilitating Child Sexual Abuse Material (CSAM), child sexual exploitation and abuse (CSAE), or any form of physical or sexual harm to minors. Zero tolerance applies.
• 5. Deepfakes, Face-Swapping & Impersonation (深度伪造/冒充他人): Any unauthorized facial replacement, deepfake video synthesis, deceptive identity simulation, voice cloning, or impersonation of real living or deceased individuals without their explicit, verifiable written consent.

6. Violation Enforcement & Account Actions (违规处置机制)

To maintain platform safety and adhere to legal standards, any violation of our Acceptable Use Policy will result in immediate disciplinary and enforcement actions:

• Immediate Content Removal: Violating inputs, prompts, and generated videos will be blocked immediately and purged from our servers.
• Credit Forfeiture & No Refund: Any credits associated with prohibited generations will be forfeited without refund or reimbursement.
• Account Suspension or Permanent Termination: Depending on the severity of the violation, user accounts may be temporarily suspended or permanently banned and blacklisted across our network.
• Legal & Law Enforcement Escalation: For severe or unlawful offenses (such as CSAM, terrorism, cyberattacks, or criminal deception), we will preserve relevant logs and report the incident directly to law enforcement authorities (including NCMEC) and judicial agencies.

7. User Reporting Channels & Procedures (用户举报渠道)

We encourage users, creators, and third-party rights holders to report any content, activity, or output that violates our Content Standards or infringes on legal rights.

You can submit a content violation or abuse report directly through our dedicated reporting channels:

• Official Reporting Email: support@vidextend.com (or abuse@vidextend.com with Subject: "[Content Violation / Abuse Report]")
• Required Information in Report: (1) URL/ID of the generated video or image; (2) Description of the violating material; (3) The specific prohibited category (e.g., Copyright, NSFW, Violence, Deepfake); (4) Supporting evidence or proof of rights ownership.
• Investigation & Response SLA: Our Trust & Safety team acknowledges all reports within 24 hours and takes appropriate investigative or remediation actions (including content takedown) within 24 to 48 hours.

8. Platform Content Moderation Mechanism (平台内容审核机制)

VidExtend deploys a comprehensive, multi-layered proactive and reactive safety architecture to prevent and remediate prohibited content:

• 1. Automated Pre-Generation Filtering (前置实时安全过滤): Multi-modal AI safety classifiers inspect all uploaded input photos and user text prompts in real-time. Requests flagged for NSFW, nudity, violence, gore, or banned keyword patterns are blocked immediately before GPU rendering commences.
• 2. Automated Post-Generation Scanning (后置输出安全复核): Synthesized video outputs undergo automated risk scanning and anomalous pattern detection prior to final delivery and playback.
• 3. Human-in-the-Loop Review (人工安全复核机制): Escalated automated alerts, high-risk flags, and community user reports are routed directly to our dedicated Trust & Safety specialists for manual review and rapid adjudication.
• 4. User Appeal Channel (用户申诉通道): Users who believe their generation was blocked or flagged in error may submit an appeal to support@vidextend.com with generation details for manual re-evaluation within 48 hours.

9. Service Availability & GPU Rendering Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. While we strive for high uptime and rapid video rendering performance:

We do not warrant that AI outputs will always be error-free, uninterrupted, or satisfy specific subjective artistic expectations.

Rendering queues may experience occasional latency fluctuations during peak global GPU cluster utilization.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall VidExtend, its operators, directors, affiliates, or suppliers be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages (including loss of profits, goodwill, data, or business interruption) arising out of your access to or use of the Service.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with standard international commercial law principles. Any dispute arising under these Terms shall first be attempted to be resolved through good-faith negotiation or binding arbitration.
